Is a BMW oil leak covered by the Lemon Law?
Yes. Persistent oil leaks are a common BMW defect that can support a Lemon Law claim. BMW engines, particularly the N20 and B48 4-cylinder turbos, are prone to leaks from the valve cover gasket, oil filter housing, and oil pan. If the dealer has replaced gaskets or seals multiple times and the leak returns, the defect substantially impairs your vehicle's reliability and value. Oil leaks can also pose a fire hazard if oil contacts hot exhaust components.
My BMW keeps going into limp mode. Can I file a Lemon Law claim?
Drivetrain malfunction warnings and limp mode activation are among the most common BMW Lemon Law claims. When your BMW reduces power and limits speed to protect the engine or transmission, it creates a serious safety hazard, especially on highways and in traffic. Common causes include turbocharger failure, fuel injector problems, and transmission software faults. If the dealer cannot permanently resolve the issue, you have strong grounds for a buyback.
Does the BMW timing chain issue qualify as a Lemon Law defect?
Timing chain and timing chain guide failure on BMW N20 and N26 engines is a well-documented defect that can cause engine rattling, misfires, and in severe cases, complete engine failure. BMW extended the warranty on the timing chain for some model years, but this does not eliminate your Lemon Law rights. If the defect appeared during your warranty period, you are entitled to pursue a buyback, replacement, or cash compensation.
Are BMW electric and plug-in hybrid vehicles covered by the Lemon Law?
Absolutely. BMW electric vehicles (iX, i4, iX3) and plug-in hybrids (330e, X5 xDrive45e) are fully protected by California Lemon Law. Known issues include high-voltage battery faults, charging failures, drastically reduced electric range compared to advertised figures, and software glitches affecting the drivetrain. These vehicles carry the same warranty protections as conventional BMW models.
BMW repairs are expensive. Will I have to pay out of pocket for a Lemon Law claim?
No. Under California Lemon Law, your attorney fees are paid by BMW if your claim is successful. You pay nothing out of pocket. Additionally, all warranty repairs that should have fixed the defect were the responsibility of BMW in the first place. If the dealer charged you for repairs that should have been covered under warranty, you may be entitled to reimbursement of those costs as part of your Lemon Law claim.
